Back Office Services Agreement

In return for back-office, which provides the following hosting services, the client agrees to pay Back Office`s total monthly fee based on monthly hosting services and the terms and conditions chosen. Unless expressly provided for in this Agreement, services are provided “as intended” and Back Office expressly disclaims all safeguards and conditions of any kind, explicit, implied or legal, including, but not limited, to tacit guarantees of ownership, non-counterfeiting, commercial nature and suitability for a particular use. Interruption of service: You hereafter acknowledge and agree that Back Office is not held responsible for delays, outages or temporary service interruptions. Each party acknowledges that it did not enter into this agreement on the basis of a guarantee or guarantee, with the exception of the one expressly stated in it. Back Office SHALL NOT BE LIABLE FOR (A) ANY LOSS OF USE, LOSS OF DATA, OR INTERRUPTION OF BUSINESS OR (B) ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, LOST PROFITS), REGARDLESS OF THE FORM OR ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF Back Office HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CUSTOMER ACKNOWLEDGES THAT THESE LIMITATIONS ARE AN ESSENTIAL ELEMENT OF THIS AGREEMENT, AND ABSENT SUCH LIMITATIONS, BACK OFFICE WOULD NOT ENTER INTO THIS AGREEMENT.
