Exemptions are covered by fundamental contract law. There is an offer of settlement and, if agreed, the acceptance of this offer. But there must be what is called a “meeting of minds”, which means that the terms of the offer and acceptance must be agreed between the two parties. If the acceptance is not in conformity with or “reflects” the offer, there is no agreement. Judge Matthew Lucas, who wrote on behalf of the Second District Court of Appeal in Florida, accepted the injured woman, who found that the acceptance did not reflect the offer and therefore there was no meeting of heads. Therefore, there was no agreement or declassification. The court was set aside and the injured woman was allowed to pursue her complaint. .
